These Terms & Conditions govern the rights, obligations, and responsibilities between Jelpala (jelpala.com, “Jelpala”) and drivers who provide delivery-related services through the Jelpala platform. Jelpala does not provide transportation services directly. Jelpala acts solely as an intermediary connecting users and drivers. All actual transportation activities and related responsibilities are borne by the driver in accordance with these Terms.

To register as a driver on Jelpala, the following requirements must be met:
Base fees, additional fees, settlement methods, and payment schedules for drivers are governed by Jelpala’s separate operational policies.
Jelpala reserves the right to modify the fee structure as necessary for service operation.
Definitions, eligibility, and standards for cancellation and waiting fees are governed by separate operational policies.
Drivers must accurately record any cancellation or waiting situations through the Jelpala app.
Drivers must comply with all applicable laws and regulations, including Canadian federal and provincial laws.
Refusal of Illegal Items: Drivers must refuse transportation if a parcel contains illegal items prohibited under Canadian law, including but not limited to drugs, firearms, or counterfeit goods.
Safe Pickup and Drop-off: Drivers must meet users only in safe locations such as inside stores. Jelpala bears no responsibility for risks, accidents, or damages arising from pickup or drop-off conducted in unsafe locations, including parking lots or roadside areas.
Duty of Care: Drivers must exercise reasonable care during transportation and make best efforts to prevent damage or loss of parcels. Parcels must be stored in a safe location throughout the transportation process.
Document Retention (BOL): Drivers must carry the Bill of Lading (BOL) issued by Jelpala, in electronic or printed form, and present it immediately upon request by authorities such as police or customs.
Verification of Contents: If the declared contents differ materially from the actual contents, drivers may request clarification from the user or conduct reasonable verification.
Drivers have the right and obligation to verify parcel weight and size. Recommended standards, acceptance ranges, and detailed procedures are governed by operational policies.
Acceptance of a parcel constitutes acknowledgment and agreement that the parcel is transportable.
A driver’s duty begins upon acceptance of a Jelpala service request and continues until delivery and confirmation are completed.
Drivers must notify users in the event of delays caused by accidents, traffic, or weather. If such circumstances materially affect service performance, drivers must immediately notify both Jelpala and the user.
Drivers may not enter into separate transportation agreements or receive compensation outside the Jelpala platform with users introduced through Jelpala.
Drivers must share their basic-duty driving routes through the Jelpala app in accordance with Jelpala instructions. Shared routes must be confirmed and accurate. Any liability arising from sharing unconfirmed or inaccurate routes rests solely with the driver.
Based on shared routes, the Jelpala app automatically suggests eligible truck stops. Drivers may select from these options. Drivers must immediately update the app if significant route or ETA changes occur due to accidents, traffic, weather, or work changes.
If a driver fails to perform duties without reasonable cause or violates these Terms, Jelpala may impose sanctions pursuant to operational policies.
Loss or Damage of Parcels: If a parcel is lost or damaged due to the driver’s fault, Jelpala may compensate the user and seek reimbursement from the driver within the compensation amount.
If loss or damage results from intentional misconduct or gross negligence:
Minor cosmetic or packaging damage occurring without driver fault during normal transportation may be excluded from compensation.
1. General Liability Insurance: Third-party bodily injury or property damage during pickup or drop-off may be covered under Jelpala’s general liability insurance, subject to policy terms.
Third-party damages arising from vehicle operation fall under the driver’s or affiliated company’s commercial auto insurance. Jelpala bears no responsibility.
2. Force Majeure: Neither Jelpala nor drivers are liable for damages or delays caused by events beyond reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
3. Accident Reporting and Cooperation: Drivers must immediately report incidents such as loss, damage, or injury. Drivers must cooperate fully with Jelpala and insurers during investigations and claims processing.
Jelpala may operate a security deposit system to ensure service stability, including coverage for non-performance, claims, or parcel loss or damage. Detailed policies will be announced separately.
This agreement becomes effective upon driver registration and approval through the Jelpala app. Termination procedures are governed by these Terms and operational policies.
Jelpala may restrict accounts or terminate this agreement without prior notice in cases of violation.
Jelpala collects only the minimum personal information necessary for service provision. Personal information is managed in accordance with Canadian privacy laws, including PIPEDA.
Drivers must not use or retain user personal information for purposes other than service performance.
Notices between Jelpala and drivers are generally provided through the app.
These Terms are governed by Canadian federal and provincial laws. Jurisdiction lies at Jelpala’s principal place of business.
